Harvey is an experienced property solicitor who made the deliberate decision to focus his practice on specialist property mediation. He is an accredited civil and commercial mediator with deep, practical expertise in every corner of property law — from commercial landlord and tenant disputes to complex TOLATA claims and development deadlocks.
That dual expertise is what sets Harvey apart. He does not just facilitate conversations between participants. He understands the deal, the law, and the commercial pressure that sits behind every property dispute. He knows what a surveyor's schedule of dilapidations really means, why a restrictive covenant can kill a development, and understands the complexities of boundary disputes.
Harvey's approach is evaluative rather than purely facilitative. Where appropriate, he will offer a candid, informed view of the merits — the kind of reality testing that breaks deadlocks and moves participants from entrenched positions to workable agreements.
Tracy Harding
Operations Director
Tracy manages the operational backbone of Harding Property Mediation. She oversees scheduling, compliance, and client communications — ensuring that every mediation runs smoothly from the initial enquiry through to the signed settlement agreement.
Solicitors and participants deal with Tracy when arranging mediations, and her responsiveness and attention to detail mean that the logistical side of the process is handled efficiently so that Harvey can focus entirely on the dispute.
Our Philosophy
Most mediators are generalists who handle everything from employment disputes to personal injury claims. We made a different choice. Harding Property Mediation focuses exclusively on property disputes because that specialism makes the difference between a settlement that sticks and a deal that falls apart.
Our approach is not rigidly fixed to one model. Depending on the circumstances of the dispute and the participants' requirements, Harvey can mediate in a facilitative or evaluative style. In a facilitative mediation, the focus is on helping the participants communicate more effectively, identify their real interests, and work towards their own negotiated resolution. In an evaluative mediation, Harvey will go further: testing assumptions, probing the evidence, and, where it will assist progress, offering a candid and informed view of the strengths and weaknesses of each side's position. The right approach depends on what will best move that particular dispute towards settlement.
We believe that most property disputes do not belong in court. Litigation is slow, expensive, and destructive to the commercial relationships that make property transactions work. Mediation, done properly by someone who genuinely understands the subject matter, resolves disputes faster, at a fraction of the cost, and with outcomes that all participants can live with.
